Buying & Selling — Terms & Conditions

These Buying & Selling Terms & Conditions (“these Terms”) govern the online purchase features on El Clasificado — buying an item directly and paying online (“Buy Now”), and selling an item to be shipped and paid out. They apply in addition to the main El Clasificado Terms of Service; where they conflict for an online purchase, these Terms control.

El Clasificado acts as the platform that connects buyers and sellers, processes payment, provides shipping labels, and holds funds in escrow until an order is complete. El Clasificado is not the seller of items listed by users unless stated otherwise.

By buying or selling online you agree to these Terms. If you do not agree, do not use the online purchase features.

You may check out as a guest or while signed in. Either way you must provide accurate contact, billing and shipping information, and you are responsible for activity on your account.

You must be legally able to enter a contract and to use the payment method you provide. Payment is taken at checkout and held securely by El Clasificado until the order is released or refunded.

To sell online you must enable online sales on an eligible listing and complete payout onboarding, including identity verification, with our payments provider (Stripe). Online selling is offered for selected categories and sellers and may be expanded over time.

You are responsible for the accuracy of your listings, for having the legal right to sell the items, and for fulfilling orders promptly. You authorise El Clasificado to collect payment from buyers on your behalf and to transfer your proceeds to your connected payout account after an order is released.

Items offered for online purchase must be described accurately, be in the stated condition, and be the seller’s to sell. Photographs must be of the actual item.

Prices are set by the seller and shown to buyers before checkout. El Clasificado may remove any listing that breaches these Terms, the main Terms of Service, or applicable law.

El Clasificado charges sellers a commission of 6% of the item price on each completed sale. The commission is calculated on the item price only — not on shipping or tax — and is deducted from the seller’s proceeds at payout. There is no listing fee; sellers are not charged for creating a listing whether or not it sells.

Shipping is paid by the buyer at checkout and is used to purchase the shipping label, including insurance. Any applicable sales tax is added at checkout and is not part of the seller’s proceeds. Fees may change on notice.

Buyers are charged the full order total (item, shipping and tax) at checkout. Funds are held by El Clasificado as escrow and are not released to the seller at that point.

A seller’s proceeds — the item price less commission — are transferred to the seller’s connected payout account after the item is delivered and the buyer inspection window (72 hours) closes with no unresolved issue. Sellers must complete payout onboarding to receive funds; until then, funds are held and released once the seller is verified. Payment processing is provided by Stripe and is subject to Stripe’s terms.

Sellers must ship within 7 days of the sale by purchasing a shipping label through El Clasificado’s shipping partner. This handling time is fixed platform-wide and is not adjustable by individual sellers. El Clasificado will send reminder notices as the deadline approaches.

Orders are shipped using a prepaid, tracked, insured label provided through El Clasificado’s shipping partner. Sellers must provide accurate parcel weight and dimensions; if a carrier re-measures a parcel and bills an adjustment, the difference may be charged to the seller.

An order that is not shipped within the 7-day handling time is automatically cancelled and the buyer is refunded in full. If a label is purchased but the parcel does not move beyond its initial scan within a further short grace period, the order is also automatically cancelled, the buyer is refunded, and the label is voided.

Each shipment is insured to the item’s value. If an item is damaged in transit, the buyer is refunded and the seller keeps their proceeds; El Clasificado recovers the cost through a shipping insurance claim. If an item is lost or never arrives, the buyer is refunded in full — because seller proceeds are held in escrow until delivery is confirmed and the 72-hour inspection window closes, a shipment that never arrives never triggers payout, and the buyer is made whole directly from the held funds rather than through a separate claim.

A buyer may report a problem or request a return from their dashboard within the 72-hour inspection window after delivery. If a return is approved, the buyer receives a prepaid return label to download and ships the item back.

When a returned item reaches the seller, the seller has a 72-hour window to flag a problem (for example the wrong item or damage); otherwise the buyer’s refund is issued automatically. Refunds are made to the buyer’s original payment method and may include the item price, shipping and tax as applicable, with tax reversed proportionally.

Shipment loss and damage — including when a buyer is refunded and a seller keeps their proceeds — are handled under Section 7 (Shipping).

If a buyer and seller cannot resolve an issue, El Clasificado reviews the dispute and decides the outcome, which may include a full or partial refund, release of funds to the seller, or another resolution. Both parties agree to provide accurate information and evidence.

Card chargebacks are handled through the card network and may result in a hold or reversal of funds. Abusive or fraudulent dispute activity may lead to suspension.

You may not buy or sell items that are illegal, restricted, counterfeit, stolen, hazardous, or that breach El Clasificado’s content and category rules. This includes items prohibited by the main Terms of Service and by applicable law.

El Clasificado may remove listings, cancel orders, and suspend accounts involved in prohibited items, and may report unlawful activity to the authorities.

Where sales tax applies, it is calculated at checkout based on the buyer’s delivery address and added to the buyer’s total. El Clasificado collects and remits applicable sales tax as the facilitator; sellers do not receive tax as part of their proceeds.

Sellers are responsible for their own income and business taxes. Nothing here is tax advice; consult a professional about your obligations.

El Clasificado may suspend or remove access to the online purchase features, cancel orders, or withhold funds where required to investigate a breach of these Terms, fraud, or a legal or safety risk.

You may stop using the online purchase features at any time. Obligations that by their nature should survive — including payment, refund, tax and dispute obligations for existing orders — continue after termination.

The online purchase features are provided “as is”. To the fullest extent permitted by law, El Clasificado is not liable for indirect or consequential losses, and its total liability for an order is limited to the amount paid for that order.

These Terms are governed by the laws of the State of California, and the parties submit to the courts located there. El Clasificado may update these Terms; material changes will be posted here with a new effective date, and continued use means acceptance. If any provision is unenforceable, the rest remains in effect.
